As a former assistant district attorney in Westchester County, I participated in the prosecution of many drunk driving cases, both contested and uncontested. In fact, there were so many, I lost count!

During that time, I watched lawyer after lawyer come into court and plead their clients guilty. Many of them, it seemed, felt they had no chance to win a trial. In other instances, I watched jury after jury find their clients guilty, having relied heavily upon the opinion testimony of police officers or, in many cases, having been influenced heavily by the misleading test results of Breathalyzer or Intoxilyzer machines.

After a while, I began to ask how could it be that a driver who the cops said couldn't stand without swaying, walk without staggering or pass any physical performance tests could navigate winding roads or drive within his or her lane at highway speeds!

OR, how could it be that a truck driver who tested more than twice the legal limit of blood alcohol was able to drive his rig without an accident!

To unravel these mysteries, I began to carefully scrutinize the police testimony and read everything that I could about blood alcohol testing devices and the effects of alcohol in the human body.

As a result of my efforts, it became clear to me that, many times, honest, hard working, innocent people were being unjustly accused of Driving While Intoxicated and worse, convicted in a legal process that was "stacked" against them. Worse yet, unprepared or inexperienced lawyers being paid to defend them often times gave bad legal advice which helped convict their clients!

In many cases I saw that the lives of good people like yourself were being interrupted and changed through deceptive law enforcement practices and exaggeration. I also learned that breath test results, so heavily relied upon by judges and juries, were not always reliable!

When I left the prosecutor's office to go into private practice, I decided that I'd use the knowledge I had gained to help those accused of DWI defend against these injustices and I've been actively engaged in defending good people like yourself ever since.

Over the past several years, drunk driving law has changed extensively, primarily to the detriment of those who are accused and their unwary lawyers. There has been a wave of prosecution- oriented legislation enacted for the purpose of depriving the accused of their driving privileges. As a result, I feel that there's less chance of a person having his constitutional rights protected in a DWI case than in any criminal case in America.

This is why I decided to write this report and make it available to people like you for free!

In it, I have identified the most common tactics and unfair advantages used by law enforcement to convict the unwary motorist of Drunk Driving and take from them their driving privileges.
